No, and yes. We must be cautious with Texas laws. Suppose insurance is required, and they have included roofing replacement as part of their estimate. In that case, we must complete the work at the same cost and fully conform to H.B. 2102 (2019), also called “deductible laws.”
However, suppose a roofing repair, replacement, or any other type of work falls outside the scope of an insurance policy. In that case, we can provide an estimate of our own based on our agreed-upon scope of work.
Yes. The Texas law, which was passed in September of 2019 and dubbed H.B. 2102, makes it explicit that homeowners, as well as contractors, violate the law if the selected contractor is discovered to pay for the deductible, absorb the cost, pay for or discount, or fail to get the amount of the deductible. Therefore, in most cases, homeowners’ out-of-pocket expense is equal to their deductible. We suggest homeowners opt for the highest amount, a 1% deductible.
